Terms of Service

By accessing a gallery, collection, online store, or digital download provided by Martin Japheth Photography, you agree to the following Terms of Service.

All photographs, digital images, previews, gallery content, designs, and related materials remain the copyright property of Martin Japheth Photography, unless otherwise agreed in writing. Purchasing images, prints, albums, or digital files does not transfer copyright ownership.

Clients and authorised gallery users are granted a personal-use licence to view, download, share, and print purchased or supplied images for personal use only. Images must not be sold, commercially exploited, entered into competitions, supplied to third parties for business use, used in advertising, used by wedding suppliers, altered, filtered, edited, cropped to remove branding, or used for AI training or image generation without written permission.

Gallery links, passwords, and download PINs are provided for the intended client and authorised guests only. Clients are responsible for deciding who they share gallery access with. Martin Japheth Photography is not responsible for unauthorised access caused by clients or guests sharing gallery links, passwords, or PINs.

Images shown in online galleries may be watermarked, resized, compressed, or preview quality. Final purchased downloads or print files will be supplied according to the product or package purchased.

Online galleries are provided for a limited period unless otherwise agreed. Clients should download and safely back up any purchased or supplied digital files before the gallery expiry date. Martin Japheth Photography cannot guarantee that galleries or files will remain available indefinitely.

Prints, albums, wall art, and other photographic products are made using professional suppliers. Colour, brightness, and contrast may appear differently on personal screens compared with printed products. This is normal and does not automatically mean a product is faulty.

Orders are processed once payment has been received. Custom photographic products, including prints, albums, wall art, and mounted products, are produced specifically for the client and may not be cancelled once production has begun, unless faulty or otherwise required by law.

If a product arrives damaged or faulty, the client should contact Martin Japheth Photography as soon as possible with clear photographs of the issue and packaging. Where appropriate, a replacement, repair, or other suitable remedy will be arranged.

Clients must not copy, screenshot, reproduce, scan, edit, resell, redistribute, or commercially use images outside the agreed licence. Suppliers, venues, magazines, blogs, agencies, businesses, or other third parties must request permission before using any images.

Martin Japheth Photography may use selected images for portfolio, website, social media, studio samples, printed promotion, competitions, editorial submission, and marketing purposes where consent has been given, where this has been agreed within the booking terms, or where there is a legitimate business basis to do so. Images of children will only be used publicly with appropriate permission from a parent or legal guardian.

Martin Japheth Photography will take reasonable care in providing photography services, editing, gallery delivery, and product fulfilment. However, no guarantee is made that every image taken during a session, event, or wedding will be delivered. Final image selection remains at the photographer’s professional discretion.

These Terms of Service are governed by the laws of England and Wales.
